This Privacy Policy explains how Z-ERGO™ (operated by Z-ERGO LLC., 254 CHAPMAN RD, STE 208 #24974, NEWARK, DELAWARE 19702, hereafter "Z-ERGO", "we", "us", or "our") collects, uses, discloses, and protects personal information ("Personal Information" or "PI") of visitors to this website and individuals who join our waitlist (the "Services").

This Policy is designed to comply with, among other laws, the European Union General Data Protection Regulation 2016/679 ("GDPR"), the UK GDPR and Data Protection Act 2018, the EU ePrivacy Directive 2002/58/EC, the California Consumer Privacy Act / California Privacy Rights Act ("CCPA/CPRA"), the Virginia Consumer Data Protection Act ("VCDPA"), the Colorado Privacy Act ("CPA"), the Connecticut Data Privacy Act ("CTDPA"), the Utah Consumer Privacy Act ("UCPA"), the Texas Data Privacy and Security Act ("TDPSA"), the Oregon Consumer Privacy Act ("OCPA"), the Children's Online Privacy Protection Act ("COPPA"), the CAN-SPAM Act of 2003, and other applicable data-protection laws.

If you are located in the European Economic Area ("EEA") or United Kingdom and we are not established there, our Article 27 GDPR representative is Z-ERGO LLC.

2. Personal Information We Collect

We collect the following categories of Personal Information:

(a) Information you provide directly (when you submit the waitlist form): your name (optional), email address (required), and your consent choices.

(b) Information collected automatically when you interact with the Services: Internet Protocol (IP) address, approximate geolocation derived from IP (country, region, city, latitude/longitude at city granularity, timezone), device characteristics (type, operating system, browser, screen resolution, device pixel ratio, user-agent string), language preference, referrer URL, UTM parameters, pages and sections visited, time spent on each section, scroll depth, click events, and event timestamps. This information is associated with a randomly generated visitor identifier and session identifier stored in your browser's localStorage and sessionStorage respectively.

(c) Information we infer on the basis of (b) above: a probabilistic gender inference derived from the first name supplied to us, and a probabilistic age-range inference derived from device/OS characteristics. These inferences are heuristic, are not represented as accurate, and are used only for aggregated audience analytics.

(d) Information we do NOT collect: payment card data, government identifiers, biometric or genetic data, precise GPS location, audio or video recordings, or special-category data under Article 9 GDPR (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health data, sex life, or sexual orientation) — unless you voluntarily include such data in a free-form message, in which case we will minimize and delete it upon discovery.

3. Categories of Sources

We collect Personal Information directly from you, from your device and browser (cookies and similar technologies), and from automated logs generated by our infrastructure.

4. Purposes of Processing

We process your Personal Information for the following purposes:

• To respond to your interest, send Kickstarter launch updates, product news, and waitlist communications, where you have provided consent;
• To operate, secure, monitor, and improve the Services, including aggregate usage analytics;
• To detect, prevent, and investigate fraud, abuse, security incidents, and violations of our terms;
• To comply with our legal obligations, court orders, lawful requests by public authorities, and to establish, exercise, or defend legal claims;
• For business administration purposes, including in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction (a successor entity will be bound by this Policy or will provide you appropriate notice).

We will not process your Personal Information for purposes materially different from those described above without providing additional notice and obtaining consent where required by law.

5. Legal Bases for Processing (GDPR / UK GDPR)

For individuals located in the EEA or United Kingdom, our lawful bases under Article 6 GDPR are:

• Consent (Art. 6(1)(a)) — for sending marketing communications and for non-essential cookies and similar technologies. You may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing performed prior to withdrawal.
• Legitimate interests (Art. 6(1)(f)) — for site security, fraud prevention, aggregate analytics necessary for the basic operation of the site, and the integrity of our systems. We have conducted a Legitimate Interests Assessment ("LIA"); a summary is available on request to info@z-ergo.com.
• Legal obligation (Art. 6(1)(c)) — for compliance with mandatory record-keeping, tax, accounting, and law-enforcement requirements.
• Contract performance (Art. 6(1)(b)) — where we need to process information to take pre-contractual steps you request (e.g., placing you on a launch waitlist that will offer pre-orders).

6. Disclosures Required by U.S. State Privacy Laws (CCPA/CPRA & Others)

This Section applies to consumers resident in California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other U.S. states with comprehensive consumer privacy laws.

Categories of Personal Information collected in the preceding twelve (12) months (Cal. Civ. Code § 1798.140(v)):

• Identifiers (e.g., name, email address, IP address, online identifiers);
• Internet or other electronic network activity information (e.g., browsing history on our site, interaction information);
• Geolocation data (approximate, derived from IP);
• Inferences drawn from the above to create a profile reflecting preferences and characteristics.

Sources, business purposes, and categories of third parties are described in Sections 3, 4, and 7 of this Policy.

"Sale" and "Sharing" of Personal Information (CCPA/CPRA, VCDPA, CPA, CTDPA, UCPA, TDPSA, OCPA). We do not sell Personal Information for monetary consideration and we do not share Personal Information for cross-context behavioral advertising. We have not done so in the preceding twelve (12) months. If we ever decide to do so, we will provide prior notice and an opportunity to opt out.

Sensitive Personal Information. We do not collect Personal Information that meets the definition of "Sensitive Personal Information" under the CPRA. Accordingly, we do not use such information for purposes that would require a right-to-limit notice.

Your rights under U.S. state laws generally include: the right to know / access; the right to delete; the right to correct inaccurate Personal Information; the right to opt out of sale, sharing, or targeted advertising; the right to data portability; the right to limit use of sensitive Personal Information (where applicable); the right to appeal a denial of a request (in CO, CT, VA, TX, OR, others); and the right not to receive discriminatory treatment for exercising your rights.

How to exercise your rights: email info@z-ergo.com with the subject line "Privacy Rights Request". We may need to verify your identity using reasonable methods before responding. We will respond within the timeframes required by applicable law (typically forty-five (45) days under CCPA, with one (1) extension of up to forty-five (45) additional days where reasonably necessary).

Authorized agents. You may designate an authorized agent to make a request on your behalf by providing the agent with signed written permission and verifying your identity directly with us.

"Shine the Light" (California Civ. Code § 1798.83). California residents may request a list of Personal Information disclosed to third parties for direct-marketing purposes. We do not disclose Personal Information to third parties for direct-marketing purposes.

7. Categories of Recipients

We may disclose Personal Information to the following categories of recipients, acting as processors or sub-processors under written contracts containing GDPR Art. 28 / CCPA "service provider" terms:

• Hosting and cloud infrastructure providers;
• Email delivery providers used to send transactional and marketing emails;
• Analytics and aggregation tooling operated by us in-house;
• Crowdfunding platforms (e.g., Kickstarter, Indiegogo) — only if and when you actively interact with our campaign there, and only the information they require to process your backing;
• Professional advisors (accountants, lawyers, auditors);
• Government bodies, courts, and law-enforcement authorities where required by law or to protect our rights;
• Acquirers, investors, and successor entities in the context of a business transaction described in Section 4.

8. International Data Transfers

We may transfer Personal Information outside your country of residence, including to the United States, in connection with the operation of our Services. For transfers from the EEA, United Kingdom, or Switzerland to countries that have not been deemed to offer an adequate level of protection by the European Commission, the UK Government, or the Swiss Federal Data Protection and Information Commissioner, we rely on appropriate safeguards under Article 46 GDPR, including the European Commission's Standard Contractual Clauses (Decision 2021/914), the UK International Data Transfer Addendum, and supplementary measures (encryption in transit and at rest, access controls, contractual restrictions). You may request a copy of these safeguards by emailing info@z-ergo.com.

9. Data Retention

We retain Personal Information only as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

• Waitlist contact data: until you unsubscribe or for thirty-six (36) months of inactivity, whichever occurs first.
• Analytics data: up to twelve (12) months, then aggregated or deleted.
• Backups: up to thirty (30) days following the retention period of the underlying record.
• Communications and compliance logs: as required by applicable law (typically up to six (6) years).

After the applicable retention period, we securely delete or irreversibly anonymize the Personal Information.

10. Data Subject & Consumer Rights

If you are in the EEA, the United Kingdom, or Switzerland, you have, subject to applicable conditions and exemptions, the right to:

• Access your Personal Information (Art. 15 GDPR);
• Rectify inaccurate or incomplete Personal Information (Art. 16);
• Have your Personal Information erased (Art. 17);
• Restrict our processing (Art. 18);
• Receive a portable copy of the Personal Information you provided to us (Art. 20);
• Object to processing based on our legitimate interests and to direct marketing (Art. 21);
• Withdraw any consent you have given (Art. 7(3)) without affecting the lawfulness of prior processing;

U.S. state-law rights are described in Section 6.

To exercise any of these rights, contact us at info@z-ergo.com. We will respond within the timeframe required by applicable law (30 days under GDPR, 45 days under CCPA, etc.). We will not discriminate against you for exercising your rights.

11. Marketing Communications and CAN-SPAM

We send marketing emails only to individuals who have actively opted in. Every marketing email we send includes: (i) a conspicuous notice that the message is an advertisement, (ii) a valid physical postal address, and (iii) a clear and functioning unsubscribe mechanism. We will honor opt-out requests within ten (10) business days, as required by the CAN-SPAM Act, and immediately upon practicable processing under GDPR. You may also opt out by emailing info@z-ergo.com.

12. Cookies and Similar Technologies

We use cookies, web storage (localStorage, sessionStorage), and tracking pixels in outgoing emails. The full description is provided in our separate Cookies Policy, which is incorporated by reference into this Privacy Policy.

13. Global Privacy Control (GPC) and Do Not Track

We treat a Global Privacy Control signal (RFC-compliant Sec-GPC: 1 header or equivalent client-side signal) and an HTTP DNT: 1 header as a request to opt out of any "sale" or "sharing" of your Personal Information for cross-context behavioral advertising, in accordance with CCPA Regulations § 7025 and similar state rules.

14. Automated Decision-Making and Profiling

We do not engage in automated decision-making that produces legal or similarly significant effects on individuals as defined in Article 22 GDPR or under U.S. state laws regulating profiling (e.g., CPRA § 1798.185, CPA, CTDPA, OCPA).

15. Children's Privacy

The Services are not directed at children under the age of sixteen (16), and we do not knowingly collect Personal Information from children under sixteen (16) without verifiable parental consent, in line with COPPA (United States) and Article 8 GDPR. If you believe we have collected such information, contact us at info@z-ergo.com and we will delete it without undue delay.

16. Security

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect Personal Information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. Measures include TLS encryption in transit, hashed and salted password storage, access controls, monitoring, audit logging, and least-privilege principles. No method of transmission over the Internet or method of electronic storage is, however, one hundred percent secure. We cannot guarantee absolute security.

Breach notification. Where required by law (e.g., Art. 33–34 GDPR; state breach-notification statutes), we will notify the competent supervisory authority and affected individuals without undue delay.

17. Third-Party Links and Services

The Services may contain links to third-party websites, plug-ins, and applications (including links to a Kickstarter or Indiegogo campaign). Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave the Services, we encourage you to read the privacy notice of every website you visit.

18. California "Shine the Light" and Notice at Collection

This Section, together with Section 6, constitutes the "Notice at Collection" required by Cal. Code Regs. § 7012. The categories of Personal Information we collect, the purposes for which we use it, and the duration for which we retain it are described above. We do not "sell" or "share" Personal Information.

19. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top will indicate the most recent revision. For material changes, we will provide additional notice by email (if we have your address) or by a prominent banner on the Services. We do not currently use third-party tracking cookies. Specifically, we do not embed Google Analytics, Meta/Facebook Pixel, LinkedIn Insight Tag, TikTok Pixel, or any cross-site advertising tag on this site. If we add any third-party technology in the future we will: (i) update this Cookies Policy with the third-party's name, purpose, and data-transfer destination; (ii) update our consent banner; and (iii) request your fresh consent before loading the third-party.

5. Email Tracking and Inline Pixels

Marketing emails we send (after you have subscribed to our waitlist) may contain a 1×1 transparent tracking pixel and rewritten links that pass through our analytics endpoint. We use these to measure aggregate open and click rates per campaign and to populate your record with engagement data so we can tailor the cadence and relevance of our communications.

You can prevent email-open tracking by configuring your email client not to load remote images automatically (this is the default in many clients, including Apple Mail Privacy Protection). You can also unsubscribe at any time using the link in any of our emails, in which case you will receive no further messages.

6. How to Manage Your Cookie Preferences

(a) Through our consent banner. On your first visit, you will see a consent banner with three options: Accept (consent to all categories), Reject (decline all non-essential cookies), and Configure (granular per-category control). Your choice is stored in zergo_consent_local as described above.

(b) Withdrawing or modifying your choice. You may change your preferences at any time by clearing the zergo_consent_local item from your browser's storage (which will cause the banner to reappear on next page load) or by emailing info@z-ergo.com.

(c) Through your browser. Most browsers let you reject or delete cookies and clear localStorage. Instructions: Chrome, Firefox, Safari, Edge. Disabling strictly-necessary cookies may cause parts of the site to malfunction.

The "up to 86% less perceived fatigue" figure refers to a field study of thirty (30) professionals in mouse-intensive roles — programmers, video editors and data-entry operators — who habitually use a conventional mouse. Each participant self-reported their end-of-day discomfort and fatigue on a 1–10 visual analog scale over one week of normal work with their usual mouse (baseline), then repeated the same measurement after two weeks of daily use of the ergonomic device. The percentage represents the maximum improvement observed under these conditions; it is not a clinical trial, is not necessarily representative of all users or usage patterns, and individual results will vary. The expression "up to" denotes a best-case result rather than a typical or guaranteed outcome.
